Man Fatally Injured Near De Wolf and Nebraska Roads
FRESNO, CA. (Monday, April 15, 2019)
A man was struck by a car and killed just before 10 p.m. Saturday, April 13, as he walked in the middle of the road near Nebraska and DeWolf roads.
Police say it is unclear why the man was in the roadway, but there was a large party nearby. California Highway Patrol officers are investigating.
The man was taken to a local hospital, where he was pronounced dead.
The driver of the vehicle remained at the scene and cooperated with officials. Police do not believe drugs or alcohol were factors in the crash.
Pedestrian Accident Investigation
In most instances, pedestrians possess the right-of-way when crossing an intersection or a street regardless if they are in a marked crosswalk. It is always a driver’s duty to yield to any pedestrian or bicyclist, however, pedestrians must take extra caution and never assume that a motorist will stop. Authorities will continue to look further into this incident as it is likely that at least some liability will be assigned to the driver.
Considering that liability seems to have already been determined, the family of the victim may be entitled to a wrongful death claim if they wish to file a lawsuit.
