Man, 32, Identified as Victim
HUNTINGTON BEACH (April 18th, 2019)
A 32-year-old man was hit by a car and killed Thursday night as he walked along Atlanta Avenue in Huntington Beach.
Huntington Beach police say a 1998 Toyota 4Runner was traveling west on Atlanta Avenue shortly before midnight when it stuck the pedestrian just west of the intersection of Schooner Lane.
The man who has been identified as Dion Van Dierman was in the westbound lane prior to being hit. He was sadly pronounced dead at the scene.
Meanwhile, the driver of the 4Runner, a juvenile, stayed at the scene and cooperated with police.
It does not appear that drugs or alcohol were a factor in the accident as the Huntington Beach Police Department.
Pedestrian Accident Investigation
In most instances, pedestrians possess the right-of-way when crossing an intersection or a street regardless if they are in a marked crosswalk. It is always a driver’s duty to yield to any pedestrian or bicyclist, however, pedestrians must take extra caution and never assume that a motorist will stop. Authorities will continue to look further into this incident as it is likely that at least some liability will be assigned to the driver.
Considering that liability seems to have already been determined, the family of Dion Van Dierman may be entitled to a wrongful death claim if they wish to file a lawsuit. Family members of wrongful death victims are entitled to compensation for funeral expenses, pain and suffering, and loss of companionship.
