Modesto Man, 29, Identified as Fatal Victim
OAKDALE, CA (April 20, 2019) The victim of a fatal car versus pedestrian accident that occurred on the morning of Saturday, April 20, 2019 has been identified as 29-year-old Benjamin Wilson of Modesto.
Wilson was struck and killed by a Hyundai Elantra traveling west as he stood on Highway 120 next to a stalled Ford EcoSport he was a passenger in just moments before the collision.
California Highway Patrol officers received reports that an SUV was partially blocking a lane on Highway 120, east of Pioneer Avenue, and responded to the scene around 1:00 A.M. Upon their arrival, officers found the stalled Ford with two occupants who stated they had run out of gas. The officers also found vehicle debris spread throughout the roadway, suggesting that there may have been a collision.
While investigating the scene officers found Wilson’s body lying in the roadway, located west of the stalled Ford. He was pronounced dead at the scene.
Despite leaving the scene after hitting and killing Wilson, the driver of the Hyundai, identified as Emad Samihakim Aiad of Ripon, will not face hit-and-run charges.
According to the California Highway Patrol, Aiad did initially stop after the collision but left for safety concerns after an altercation ensued. He called 911 shortly after to report the incident.
Bradley Hiler Arrested for DUI
The driver of the stalled Ford, identified as 31-year-old Bradley Michael Hiler of Stockton, was arrested at the scene for suspicion of DUI.
Pedestrian Accident Investigation
In most instances, pedestrians possess the right-of-way when crossing an intersection or a street regardless if they are in a marked crosswalk. It is always a driver’s duty to yield to any pedestrian or bicyclist, however, pedestrians must take extra caution and never assume that a motorist will stop. Authorities will continue to look further into this incident as it is likely that at least some liability will be assigned to the driver.
Considering that liability seems to have already been determined, the family of Benjamin Wilson will be entitled to a wrongful death claim if they wish to file a lawsuit.
