A 65-year-old man in a wheelchair was killed in a crash at the intersection of East Shields and North Cedar Avenue in Fresno on Monday.

Hubert Mullins, 65, was struck and killed while crossing the street at about 6 a.m.

The driver of the vehicle who hit Mullins, a homeless man, could not see him because he was wearing dark clothing.

The driver remained on scene and will not face any criminal charges.

According to Fresno officials, a total of nine pedestrians have been struck and killed by vehicles in Fresno this year.

Pedestrian Collision Investigation

In most instances, pedestrians possess the right-of-way when crossing an intersection or a street regardless if they are in a marked crosswalk. It is always a driver’s duty to yield to any pedestrian or bicyclist, however, pedestrians must take extra caution and never assume that a motorist will stop. Authorities will continue to look further into this incident as it is likely that at least some liability will be assigned to the driver.

Considering that liability seems to have already been determined, the family of Hubert Mullins will be entitled to a wrongful death claim if they wish to file a lawsuit.
