Collision Investigation & Liability
In most instances, pedestrians possess the right-of-way when crossing an intersection or a street regardless if they are in a marked crosswalk. It is always a driver’s duty to yield to any pedestrian or bicyclist, however, pedestrians must take extra caution and never assume that a motorist will stop. Authorities will continue to look further into this incident as it is likely that at least some liability will be assigned to the driver.
Considering that liability seems to have already been determined, the family of Brian Wambaa may be entitled to a wrongful death claim if they wish to file a lawsuit. Family members of wrongful death victims are entitled to compensation for funeral expenses, pain and suffering, and loss of companionship.
